Movement Practice Participation & Liability Waiver

centered. yoga | Dave Hay

Participation in sessions with Dave Hay under centered. yoga may include yoga (power, vinyasa, yin, restorative, and other styles), strength training, suspension training, dance-based fitness, mobility work, and other movement-based practices. Sessions may be conducted in heated or non-heated conditions and take place at a private residential studio in Newburyport, Massachusetts.

By choosing to participate, you acknowledge personal responsibility for your physical well-being and agree to the terms below.

1. Assumption of Risk

I understand that physical activity involves inherent risks, including but not limited to:

  • Muscle strain or soreness

  • Sprains, joint injury, or soft tissue injury

  • Slips or falls

  • Dizziness, fatigue, or fainting

  • Increased heart rate or blood pressure

  • Dehydration or heat-related discomfort

I voluntarily assume full responsibility for any injury, illness, or loss that may result from participation.

2. Heated Sessions

I understand that certain sessions may be conducted in a heated environment. Exercising in heat increases physical demand and may elevate the risk of dehydration, fatigue, dizziness, or heat-related illness.

I agree to hydrate appropriately, monitor my physical condition, rest when needed, and discontinue participation if necessary.

3. Equipment & Movement Practices

I understand that some sessions may involve bodyweight resistance, suspension training, balance work, or dance-based cardiovascular movement.

I agree to follow instruction, use equipment as directed, and move within my personal limits.

4. Health Responsibility

I affirm that I am physically able to participate in moderate to vigorous physical activity. I understand it is my responsibility to consult a physician if I have medical concerns.

I agree to inform Dave Hay of any injuries, medical conditions, pregnancy, or changes in health that may affect participation.

I understand that Dave Hay is not a medical professional and does not provide medical diagnosis or treatment.

5. Residential Studio & Property Access

I understand that sessions take place at a private residential property. Participation includes entering and exiting the premises.

I acknowledge and assume ordinary risks associated with accessing a residential property, including walking on driveways, steps, walkways, and stairways.

I agree to exercise reasonable care while on the property.

6. Release of Liability

To the fullest extent permitted under Massachusetts law, I release and discharge David C. Hay, Francis T. Lucchesi, and centered. yoga from claims, demands, damages, or causes of action arising out of or related to my participation in sessions or my presence on the residential property.

This release applies to claims arising from ordinary negligence but does not extend to gross negligence or intentional misconduct.

7. Acknowledgment

By checking the waiver box on the scheduling form, I acknowledge that:

  • I have read this waiver in full

  • I understand its contents

  • I voluntarily agree to its terms

  • I am 18 years of age or older

This agreement shall be governed by the laws of the Commonwealth of Massachusetts.
